Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Gluco AI mobile application, website, and related services (together, the "Service") provided by Gluco AI ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Who can use Gluco AI
You must be at least 13 years old (or 16 where required by local law) and able to form a binding contract. If you are using Gluco AI on behalf of an organization, you represent that you have authority to bind that organization.
2. Medical disclaimer — please read carefully
Gluco AI is a wellness and educational tracking tool. It is not a medical device, and it is not a substitute for professional medical advice, diagnosis, or treatment.
- Glucose predictions, carb counts, and recommendations are estimates generated by AI and may be wrong.
- Do not use Gluco AI to make insulin dosing, medication, or treatment decisions.
- Always consult a qualified healthcare professional for questions about your health.
- If you are having a medical emergency, call your local emergency number immediately.
3. Your account
You are responsible for keeping your account credentials secure and for any activity under your account. Tell us right away at support@glucoai.app if you believe your account has been compromised.
4. Subscriptions, billing, and refunds
Gluco AI offers a free tier and optional paid subscriptions. Subscriptions are sold through the Apple App Store and are subject to Apple's terms.
- Billing: subscriptions auto-renew at the price shown at purchase unless you cancel at least 24 hours before the renewal date.
- Managing your subscription: in the iOS Settings app, tap your name → Subscriptions → Gluco AI.
- Free trials: if offered, any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds: all purchases are handled by Apple and are subject to Apple's refund policy. We do not directly process refunds.
- Price changes: we may change subscription prices. We will give you advance notice and a chance to cancel before any price change takes effect.
5. License to use the Service
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.
6. Your content
You retain ownership of the content you submit to the Service, including food photos and logs ("Your Content"). You grant us a worldwide, royalty-free license to host, store, process, analyze, and display Your Content solely to provide, secure, and improve the Service. You represent that you have the rights to submit Your Content and that it does not violate any law or anyone else's rights.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to harm others.
- Reverse engineer, decompile, scrape, or attempt to extract source code, models, or underlying datasets.
- Interfere with, overload, or disrupt the Service or its infrastructure.
- Use the Service to build a competing product or to train a competing AI model.
- Submit content that is infringing, harassing, hateful, or illegal.
- Resell, sublicense, or commercially exploit the Service without our written permission.
- Bypass, disable, or circumvent any security feature or access restriction.
8. AI outputs
The Service uses artificial intelligence to analyze photos and predict glucose impact. AI output can be inaccurate, incomplete, or biased. You are solely responsible for how you use any AI output, and you should independently verify important information, especially anything that could affect your health.
9. Third-party integrations
If you connect third-party services (such as Dexcom or Apple Health), your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or their outages.
10. Intellectual property
The Service, including its software, design, content, models, and trademarks, is owned by Gluco AI or its licensors and is protected by intellectual property laws. You may not use our name or logos without our prior written consent.
11. Termination
You can stop using the Service at any time and delete your account from the app. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we are required to do so by law. Sections that by their nature should survive termination will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI PREDICTION IS CORRECT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLUCO AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.
14. Indemnification
You agree to indemnify and hold Gluco AI and its affiliates harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service, violation of these Terms, or violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts. This section does not apply to residents of jurisdictions where such terms are prohibited.
16. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify you in the app or by email. By continuing to use the Service after changes take effect, you accept the updated Terms.
